Terms of Sale — Measure Twine

Please read these Terms of Sale (“Terms”) carefully. These Terms govern your purchase of products from Measure Twine, LLC through our website, measuretwine.com (the “Site”). By placing an order, you agree to be bound by these Terms and our Privacy Policy.

1. Orders and Acceptance

Your placement of an order on our Site is an offer to purchase our products. We may accept your offer by processing your payment and shipping the product. We reserve the right to refuse or cancel any order at any time for any reason, including but not limited to product availability or errors in the description or price of the product.

2. Pricing and Payment

All prices are shown in U.S. dollars. Prices are subject to change without notice. Payment is due at the time of order. We use a third-party payment processor (Shopify Payments) to handle all transactions securely.

3. Shipping and Delivery

We will ship your order to the address you provide. Shipping and handling charges will be specified during the checkout process. The risk of loss for items purchased passes to you upon our delivery of the items to the shipping carrier. We are not responsible for shipping delays caused by the carrier or for items lost or damaged in transit.

4. Returns and Refunds

Our return policy is governed by our Return & Refund Policy. By agreeing to these Terms of Sale, you also agree to the terms of the Return & Refund Policy.

5. Product Specifications and Intended Use

Measure Twine is designed to be a convenient tool for general estimation and measurement. We strive for accuracy in our manufacturing process; however, minor variations in the length or color of the twine sections may occur.

The product is not a calibrated or certified measurement device. It should not be used for survey-grade, engineering, architectural, or other professional applications where precision and certified accuracy are required. By purchasing this product, you acknowledge and agree that it is intended for general-purpose use only and you assume all risk associated with its use.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF MEASURE TWINE, LLC FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE PRODUCT OR THESE TERMS SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCT THAT IS THE SUBJECT OF THE CLAIM.

IN NO EVENT SHALL MEASURE TWINE, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS OR USE) ARISING OUT OF OR RELATING TO THE PRODUCT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

7. Indemnification

You agree to defend, indemnify, and hold harmless Measure Twine, LLC and its officers, directors, and employees from and against any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the product in violation of these Terms or any applicable law.

8. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law principles.

ANY DISPUTE OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR PURCHASE OR USE OF THE PRODUCT SHALL BE RESOLVED BY BINDING ARBITRATION IN SARASOTA COUNTY, FLORIDA, RATHER THAN IN COURT. YOU AGREE THAT BY ENTERING INTO THESE TERMS, YOU AND MEASURE TWINE, LLC ARE EACH WAIVING THE RIGHT TO A JURY TRIAL.

9. Entire Agreement

These Terms, along with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and Measure Twine, LLC regarding your purchase and supersede all prior communications and proposals.
